Any dispute arising out of or relating to this Refund Policy or our services shall be resolved through binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association. The arbitration shall be conducted in Delaware, and judgment on the award may be entered in any court having jurisdiction. Each party shall bear its own costs and attorneys' fees. This arbitration agreement does not preclude either party from seeking injunctive relief in court for intellectual property infringement or breach of confidentiality obligations.

This Refund Policy shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Subject to the arbitration provisions above, any legal action or proceeding arising under this Refund Policy will be brought exclusively in the federal or state courts located in Delaware.
