This Refund Policy describes the terms under which refunds may be requested and processed for subscriptions to Halogen Presence™, Halogen AI, Inc.'s Answer Engine Optimization (AEO) platform. It supplements our Terms of Service; in the event of a conflict, the Terms of Service govern except with respect to the specific refund terms set out here.

1. Overview

At Halogen AI, we want you to be satisfied with the Services. This Refund Policy outlines when refunds may be requested and how they are processed. Except as expressly described in this policy or as required by applicable law, subscription fees are non-refundable, consistent with our Terms of Service.

2. Free Trial

We may offer a free trial of the Services. If a free trial is made available to you, you may evaluate the Services during the trial period without charge. Unless you cancel before the trial ends or before a paid subscription begins, you may be charged for the subscription in accordance with the plan you selected. Trial availability and duration are as described at sign-up or as otherwise communicated to you.

3. 14-Day Money-Back Guarantee

3.1 Eligibility

We offer a 14-day money-back guarantee for new paid subscriptions to the Services. The guarantee applies to first-time subscribers and to the initial subscription period only (not to renewals), and to both monthly and annual plans. The applicable plans and prices are those shown on our pricing page or in your order form at the time of purchase.

3.2 Guarantee Period

The 14-day guarantee period begins on the date your initial payment is processed and your paid subscription becomes active.

3.3 How to Request a Refund

  1. Submit a written request by email to billing@halo-gen.ai.
  2. Include your account information and subscription details.
  3. Optionally, share the reason for your request — helpful for improving the Services, but not required.

4. Refund Conditions and Restrictions

4.1 Eligible Refunds

Refunds may be issued for:

  • Requests made within the 14-day money-back guarantee period;
  • Billing errors (such as duplicate charges, incorrect amounts, or charges after a confirmed cancellation);
  • Unauthorized charges reported within 60 days;
  • Termination of your subscription by Halogen AI without cause;
  • Any refund required by applicable law.

4.2 Non-Refundable Circumstances

Except where required by law, refunds will not be issued for:

  • Requests made after the 14-day guarantee period;
  • Subscriptions terminated for violation of our Terms of Service or acceptable-use requirements;
  • Accounts terminated due to fraudulent activity or abuse;
  • Partial billing periods for cancelled subscriptions after the guarantee period;
  • Add-on capacity (such as additional tracked-prompt or organization quotas) used beyond the guarantee period;
  • Custom development or professional services, if any;
  • Non-use of, or dissatisfaction with, the Services after the guarantee period.

Usage of the Services is subject to the quotas described in your plan or order form (for example, tracked-prompt limits, organization limits, and the frequency of automated checks). Exceeding or fully consuming a plan's quota during the guarantee period does not by itself disqualify a refund, but the guarantee is intended for good-faith evaluation of the Services.

5. Refund Processing

5.1 Refund Amount

  • Within the 14-day guarantee: Full refund of the initial subscription fees paid.
  • Annual plans cancelled after 14 days: No refund for unused months, except where required by law.
  • Billing errors: Full refund of the erroneous amount.
  • Service unavailability: Where a service-level commitment applies, a prorated credit or refund for documented downtime exceeding that commitment.

5.2 Processing Time

  • Refund requests are reviewed within 3 business days;
  • Approved refunds are processed within 5–10 business days;
  • Refunds are issued to the original payment method;
  • You will receive email confirmation when your refund is processed.

5.3 Effect on Your Account

Upon refund approval for a full money-back refund, your paid subscription will end and access to paid features will cease. You may request an export of your data before deletion in accordance with our Privacy Policy and Data Processing Agreement; data is then deleted or anonymized in accordance with those documents.

6. Subscription Cancellations

6.1 Cancellation Process

You may cancel your subscription at any time through your account settings or by contacting billing@halo-gen.ai. To avoid charges for the next billing period, cancellation must be completed before your renewal date.

6.2 Effect of Cancellation

  • Monthly subscriptions: Service continues until the end of the current billing period;
  • Annual subscriptions: Service continues until the end of the prepaid term;
  • No partial refunds for unused time after the 14-day guarantee period, except where required by law.

7. Payment Failures and Grace Period

7.1 Failed Payment Grace Period

  • You will receive email notification of a payment failure;
  • A grace period of 5 days is provided to update your payment information;
  • We may re-attempt payment during the grace period;
  • A reminder is sent before any account suspension.

7.2 Account Suspension

If payment is not received within the grace period, your account may be temporarily suspended. Service can be restored upon successful payment. Accounts suspended for more than 30 days may be terminated, consistent with our Terms of Service.

8. Disputes and Chargebacks

8.1 Dispute Resolution

Please contact us at billing@halo-gen.ai before initiating any chargeback or dispute with your financial institution. We will work in good faith to resolve billing concerns promptly. Any dispute arising out of or relating to this Refund Policy is subject to the dispute-resolution and arbitration provisions of our Terms of Service.

8.2 Chargeback Consequences

Accounts associated with chargebacks may be:

  • Suspended pending investigation;
  • Terminated if the chargeback is determined to be unjustified;
  • Subject to collection of outstanding amounts owed;
  • Prohibited from future subscriptions.

9. Special Circumstances

9.1 Enterprise and Custom Agreements

Custom or enterprise agreements may contain different refund terms. In case of conflict, the terms in your signed agreement prevail over this general policy.

9.2 Promotional Offers

Promotional pricing or discounts may carry modified refund terms, which will be stated at the time of purchase. Unless otherwise specified, promotional subscriptions are subject to the same 14-day guarantee.

9.3 Service Credits

In lieu of refunds, we may offer service credits for minor service disruptions, certain limitations, or customer-retention purposes.

Service credits have no cash value and expire after 12 months if unused.

10. Policy Modifications

Halogen AI may modify this Refund Policy at any time. Changes are effective upon posting to our website. We will notify active customers by email of material changes. Continued use of the Services after modifications indicates acceptance of the updated policy.

11. Governing Law and Dispute Resolution

This Refund Policy is governed by the laws of the State of Washington, United States, without regard to its conflict-of-law provisions, consistent with our Terms of Service. Any dispute arising out of or relating to this Refund Policy is subject to binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association, as set out in the Terms of Service. Nothing in this policy prevents either party from seeking injunctive relief for intellectual-property infringement or breach of confidentiality obligations.

12. Severability

If any provision of this Refund Policy is held invalid or unenforceable, the remaining provisions will continue in full force and effect.
